Terms and Conditions

1. Definition of Seller

1.1 Access to this web site (the “Web Site”) is subject to and in accordance with the following terms and conditions. Please read these terms and conditions carefully before using this site.

1.2 These terms and conditions are between (“we/us/our”) and you (on behalf of yourself and/or the company, member, or supplier for which you have registered) the user of this Web Site (“you”).

1.3 The ‘Buyer’ means the person who buys or agrees to buy Goods from the Seller. The ‘Seller’ means BrassWindFix.

1.4 ‘Conditions’ means any Conditions of Sale expressed in this document and any special conditions which have been agreed in writing by the Seller.

1.5 On accessing the Web Site on this occasion, and on each subsequent occasion, you will be deemed to have accepted all of the terms and conditions that apply to its use and to the facilities, services and information provided by it. We reserve the right to alter these terms and conditions at any time and it is your obligation to check if changes have been made. Your use of the Web Site after changes are posted on-line will constitute acceptance of the new terms and conditions.

2. Statutory Rights

2.1 These Terms and Conditions will not affect your statutory rights.

3. Web Site Alterations

3.1 BrassWindFix reserves the right to remove or cease to supply any product or service contained on this website, at any time and without prior notice. We shall not be liable to you in any way whatsoever for removal of any product or service from the web site.

4. Payment and Prices

4.1 Payment can be made via the internet by most major credit/debit cards or PayPal.

4.2 Minimum transaction value of £5.00 applies.

4.3 If you choose to pay by credit card then the details of your card number will be securely encrypted before they are transmitted over the Internet. Your card details will not be stored once your order has been processed and details will be deleted as soon as the transaction is completed.

4.4 Orders made are immediately charged. Please refer to PayPal terms & conditions for further information.

4.5 All prices and details of all products and services, including any offers shown online, are subject to change without notice. Price, specification and availability information is subject to change without notice.

4.6 All products and services are subject to availability and the Seller reserves the right to revise prices prior to dispatch of goods.

4.7 All pictures of products are purely for illustrative purposes and we make no guarantee that they are an exact interpretation of the product.

4.8 All prices, charges for packing, postage and carriage are subject to VAT regulations. VAT is not currently charged by BrassWindFix.

4.9 Payment must be made in full before any Goods can be dispatched.

4.10 The prices published on the BrassWindFix website apply only to orders placed over the Internet. They may vary if you visit the retail shop.

5 Postage/Shipping Charges

5.1 Instruments: All instruments are despatched free of charge by courier (UK mainland only). For deliveries outside UK mainland additional charges will apply.

5.2 Accessories: Accessories are normally sent according to current Post Office charges. Postage options and charges will be advised at checkout where applicable.

6. Taxes and VAT

6.1 All prices are shown including VAT at the current applicable rate. Where VAT is applicable, it is shown on the website. VAT is not currently charged by BrassWindFix.

7. Title to Goods

7.1 BrassWindFix retains full title to all goods supplied until item(s) are paid for in full. In the event of the customer’s insolvency BrassWindFix reserves the right to reclaim goods for which full payment has not been made.

7.2 The risk in Goods passes to the Buyer on delivery of the Goods or on payment by the Buyer but kept at the Seller’s premises at the Buyer’s request.

7.3 The Seller remains the owner of the Goods until the Seller has been paid in full for such Goods.

8. Carriage & Delivery

8.1 We will deliver your goods within 24-48 hours if in stock. If the item you have ordered is unavailable you will be notified and it will be sent to you as soon as it is in stock.

8.2 The Seller may deliver by installments or select an alternative carrier without notice to the Buyer.

8.3 The Seller shall not be liable for any losses or expenses incurred from any failure to meet estimated delivery dates.

9. Non-delivery of goods

9.1 If your goods are not delivered to you within seven days of the dispatch date you must notify us immediately, otherwise we cannot accept responsibility for the lost Goods.

10. Cancellation and Returns

10.1 The Buyer must inspect the Goods immediately upon receipt and notify the Seller within five days if the Goods are damaged or do not comply with the Contract. If the Buyer fails to do this the buyer is deemed to have accepted the Goods.

10.2 Any Goods which are received defective or damaged must be kept together with the original packing at the Buyer’s risk until the Seller can inspect or collect the Goods or notify the Buyer to return the goods.

10.3 If the goods you receive are faulty please return them to us in their original condition within seven days and we will either repair or replace them, or refund the cost of the goods.

10.4 If the Goods you receive are not what you ordered, please return them to us in their original condition within seven days and we will either replace them with the Goods you ordered, or refund the cost of the Goods and carriage.

10.5 In addition to the above, you may in most cases return any Goods within seven working days of receipt without giving any reason. Postage in these instances is non-refundable and the Goods must be in their original condition. These conditions do not apply to “Special Order” items. 10.6 If you choose to return any goods you must ensure that the goods are properly packaged and sent at your cost by a secure carrier. It is your responsibility to take reasonable care to ensure that they reach us undamaged. If goods are found to be damaged on return then you will be charged the full cost of the item.

10.7 If you do not pay for the cost of return then we may deduct the cost of retrieving the goods from any refund due to you in respect of the order. We recommend that you use a recorded delivery service for all returns.

10.8 If a refund is due to you it will be made within 10 days.

11. Force Majeure

11.1 The Seller will not be under any liability in the event that the Seller is prevented or delayed from supplying any Goods by cause beyond the Seller’s control.

12. Damage in transit

12.1 Any claim arising from damage in transit must be made to BrassWindFix immediately upon receipt of the goods. Please check the cases and contents upon receipt and before signing for them.

12.2 Goods seen to be damaged should be signed “Damaged in transit” and packaging materials should be preserved for inspection. Damaged goods must be reported within two working days of delivery otherwise BrassWindFix will not accept responsibility.

13 Dispute

13.1 In the event of a dispute between the Buyer and the Seller, the Buyer agrees to submit the dispute to Arbitration as a legally binding alternative to Court action. These Conditions shall be construed in accordance with English Law.

14. Complaints

14.1 In the unlikely event of a complaint about our service, please contact us on 01934 861226 or justin@brasswindfix.co.uk. We will treat all complaints fairly and confidentially, and we will endeavour to respond to all complaints as a priority.

15 Privacy

15.1 We are committed to protecting your privacy. All the information you give us is collected lawfully and in accordance with current Data Protection legislation and is collected only for the purpose of processing your order and collecting information for our own marketing purposes. All the information you give us when you register, or when you place an order, is treated as confidential and we will not share any of this information with any third party, unless you give us your express permission to do so.

16 Links to Other Websites

16.1 Your use of the BrassWindFix website and any purchase of any products using the BrassWindFix website will be governed by English Law and will be deemed to have occurred in the United Kingdom.

16.2 Certain (hypertext) links will lead you to websites that are not under the control of BrassWindFix. BrassWindFix has no control over this content and will accept no responsibility or liability in respect of the material on any such other website.

17.1 All website design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) and all other material on this website or their content and technology providers are copyright BrassWindFix.

17.2 All rights reserved. Permission is granted to copy and print portions of this website for the sole purpose of placing an order with BrassWindFix. Any other use of materials on this website without the prior written permission of BrassWindFix is strictly prohibited.

18 Changes to Terms and Records of Agreements

18.1 We reserve the right to change these terms and conditions at any time by posting changes on the website. It is your responsibility to review the website terms and conditions regularly to ensure you are aware of the latest terms and conditions.

18.2 Your use of this website after a change has been posted will be deemed to signify your acceptance of the modified terms and conditions.
